Terms and Conditions

General Provisions

1.1. These terms of purchase and sale (hereinafter referred to as the “Terms”) are a mandatory legal document that establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the online store.

1.2. The Seller reserves the right to change, amend, or supplement the Terms at any time, in accordance with the requirements of the laws of the Republic of Lithuania. The Buyer is informed of any changes on the online store website. The Terms that are valid at the time of order placement apply to the purchase and sale transaction.

1.3. Purchases in the online store can be made by:

1.3.1. Competent individuals, i.e., adults whose capacity is not restricted;

1.3.2. Minors aged 14 to 18 years, with the consent of parents or guardians, except in cases where they manage their own income;

1.3.3. Legal entities;

1.3.4. Authorized representatives of all the above-mentioned persons.

1.4. By confirming the Terms, the Buyer confirms their right to purchase goods in the online store according to clause 1.3.

1.5. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms a shopping cart in the online store, specifies the delivery address, selects the payment method, and clicks the “Confirm Order” button (see clause 5 “Order Placement, Prices, Payment Procedure, Terms”).

Personal Data Protection

2.1. The Buyer can order goods in the online store by:

2.1.1. Registering in the online store and entering the requested data in the registration form;

2.1.2. Without registering in the online store.

2.2. When ordering goods, the Buyer must provide the necessary personal data for proper order fulfillment: name, surname, delivery address, phone number, and email address.

2.3. By confirming the Terms, the Buyer agrees that their personal data will be processed for the purpose of selling goods and services in the online store, for the Seller’s business analysis, and for marketing purposes.

2.4. The Buyer agrees to receive notifications necessary for order fulfillment via the provided email address and phone number.

2.5. The Buyer is obligated to protect their login data and not disclose it to others.

3. Buyer’s Rights and Obligations

3.1. The Buyer has the right to purchase goods in the online store according to the Terms.

3.2. The Buyer has the right to withdraw from the purchase and sale contract by notifying the Seller in writing (by email) no later than 14 working days from the date of delivery of the goods, except in cases where the contract cannot be withdrawn according to the laws of the Republic of Lithuania.

3.3. The Buyer can exercise the right specified in clause 3.2 only if the goods have not been damaged, the appearance of the goods has not changed, and they have not been used.

3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.5. If the Buyer’s provided data changes, they must immediately update it.

3.6. The Buyer undertakes not to transfer their login data to third parties. If the login data is lost, the Buyer must immediately inform the Seller.

3.7. By using the online store, the Buyer agrees to these Terms and undertakes to comply with them and not to violate the laws of the Republic of Lithuania.

4. Seller’s Rights and Obligations

4.1. The Seller undertakes to create conditions for the Buyer to properly use the services of the online store.

4.2. If the Buyer tries to harm the operation or security of the online store, the Seller has the right to restrict or suspend the Buyer’s access to the online store or cancel their registration.

4.3. The Seller undertakes to respect the Buyer’s right to privacy regarding the personal information provided in the registration form.

4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the specified address.

5. Order Placement, Prices, Payment Procedure, Terms

5.1. The Buyer can purchase goods in the online store by choosing one of the following methods:

5.1.1. Register in the online store by entering the requested data in the registration form.

5.1.2. Without registering in the online store.

5.2. The Buyer must select the ordered goods, specify the delivery address, and choose the payment method. Before confirming the order, the Buyer must review the information and make sure all details are correct. The Seller is not responsible for incorrectly entered information and any related consequences.

5.3. The purchase and sale contract is considered concluded from the moment the Buyer forms a shopping cart in the online store, specifies the delivery address, selects the payment method, and clicks the “Confirm Order” button.

5.4. Prices in the online store are indicated in euros and include VAT. If the Seller provides for the delivery of goods free of charge, the Buyer is informed about this before confirming the order.

5.5. The Buyer must pay for the ordered goods within 3 (three) working days from the date of order confirmation. If the Buyer does not pay within this period, the Seller has the right to cancel the order.

 

6. Delivery of Goods

6.1. The Buyer can choose the method of delivery of goods that is convenient for them:

6.1.1. By courier to the specified address;

6.1.2. To the specified parcel terminal.

6.2. The Buyer undertakes to indicate the exact place of delivery of the goods.

6.3. The Buyer undertakes to accept the goods themselves. If the Buyer cannot accept the goods themselves and the goods are delivered to the specified address, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong person.

6.4. The Seller undertakes to deliver the goods to the Buyer within the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the goods are not in stock, and the Buyer is informed about the lack of goods. The Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery.

6.5. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are handed over to the Buyer.

6.6. Upon receipt of the goods, the Buyer must check the condition of the shipment and the goods and sign the delivery document. If the Buyer notices any damage to the packaging, the goods, or discrepancies in the quantity or assortment, the Buyer must indicate this in the delivery document. If the Buyer does not perform these actions, the Seller is released from liability for any violations of the terms of the goods that were not noted by the Buyer in the delivery document.

7. Product Quality Guarantee and Expiration Date

7.1. The characteristics of each product sold in the online store are generally indicated in the product description.

7.2. The Seller is not responsible for the fact that the goods in the online store may not correspond in their color, shape, or other parameters to the actual size, shape, and color of the goods due to the characteristics of the monitor used by the Buyer.

7.3. The Seller provides a quality guarantee for certain types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.

7.4. The product warranty is valid for 1 year from the date of purchase. If the product fails within this time, it will be repaired free of charge, replaced, or a refund will be issued.

7.5. The warranty does not apply to defects caused by the customer’s fault or negligence.

8. Returns and Cancellations

8.1. The Buyer has the right to withdraw from the purchase and sale contract without giving reasons within 14 days from the date of delivery of the goods.

8.2. The right of withdrawal does not apply to goods that are not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery, as well as to perishable goods, customized goods, and goods produced to the Buyer’s specifications.

8.3. To exercise the right of withdrawal, the Buyer must notify the Seller of their decision by submitting a clear statement or the model withdrawal form provided by the Seller.

8.4. The Seller must refund the price of the goods to the Buyer within 14 days from the date of receipt of the returned goods.

8.5. The Buyer must return the goods to the Seller at their own expense, except in cases where the goods are returned due to their non-conformity or defects.

9. Liability

9.1. The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer assumes responsibility for the consequences of providing incorrect data.

9.2. The Buyer is responsible for the actions taken using the online store.

9.3. The Buyer is responsible for not disclosing their login details and for securing them. If the Buyer’s login details become known to a third party, the Buyer must immediately inform the Seller.

9.4. The Seller is not responsible for the information provided on other companies’ websites, even if the Buyer accesses these websites through links in the Seller’s online store.

10. Final Provisions

10.1. These Terms are concluded and interpreted in accordance with the laws of the Republic of Lithuania.

10.2. Any disputes arising between the Buyer and the Seller shall be resolved through negotiations. If an agreement is not reached, disputes are resolved in the courts of the Republic of Lithuania.

10.3. The Seller may transfer their rights and obligations under this contract to a third party without the Buyer’s consent, provided that this does not affect the Buyer’s rights under the contract.
